Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Framework website, located at https://yourframework.com (the “Website”), and the Framework mobile applications and services that facilitate direct access to certain health services provided by physicians who are contracted with or employed by affiliated physician practices (the “Physician(s)”), for the ordering of certain prescription medications and other products from Framework’s affiliated pharmacies and pharmacy partners, and for the payment of these services (collectively, the “Services”).
Please note that supplemental terms applicable to Physicians may be found in Section 13 of these Terms. You agree that by visiting the Website, or by registering or using the Services, you, the individual (“you” or “your”), are entering into a legally binding agreement with Framework, located at 151 C. de San Fransisco, San Juan, Puerto Rico 00646, based on these Terms as well as Framework’s Privacy Policy and Framework’s Informed Consent, each of which are hereby incorporated by reference in these Terms (collectively, the “Agreement”). Your access to and use of the Services are conditioned on your acceptance of and compliance with the terms of this Agreement. By accessing or using the Services, you agree to be bound by the Agreement.
Basic Terms
Framework acts as a technology platform to connect registered users of the Website with Physicians and pharmacies for medical consultations and dispensing of medications prescribed by the Physicians. Framework is not a health care provider or pharmacy and does not offer or provide any medical advice, treatment recommendations, or pharmacy services. You acknowledge that you are not entering into a physician-patient relationship with Framework, and that Framework is not liable for any advice, medical care, or treatment you receive from the Physicians or pharmacies affiliated with Framework (“Pharmacies”) or for any consequences, injury, or harm that may result therefrom.
Physicians employed or under contract with affiliated medical practices (the “Medical Practice”) provide specific medical consultations through the Website. Framework does not own the Medical Practice, nor does Framework control the practice of medicine by the Medical Practice or its Physicians. The content of the Website and the Services, including without limitation text, copy, audio, video, photographs, illustrations, graphics, and other visuals, is for informational purposes only and does not constitute professional medical advice, diagnosis, treatment, or recommendations of any kind by Framework.
You are responsible for verifying that any information you provide to Framework or a treating Physician is accurate and complete. Framework will not be liable for any damages or losses that occur as a result of untruthful, inaccurate, or otherwise incomplete information. The Services are not a substitute for in-person treatment or advice of your primary care physician or other health care providers. The Website facilitates medical consultations limited to diagnosis and treatment of certain health issues only. If you are not feeling well, contact your primary care physician. The Website is not to be used for medical emergencies. IF YOU ARE HAVING A MEDICAL EMERGENCY, PLEASE DIAL 911 OR GO IMMEDIATELY TO THE EMERGENCY ROOM.
Eligibility to Use the Services
The Services currently are available only in the States of Arizona, California, Colorado, Connecticut, Florida, Georgia, Hawaii, Idaho, Illinois, Indiana, Iowa, Kentucky, Maine, Maryland, Massachusetts, Michigan, Minnesota, Missouri, Montana, Nebraska, Nevada, New Hampshire, New Jersey, New York, North Carolina, Ohio, Oklahoma, Oregon, Pennsylvania, South Carolina, Tennessee, Texas, Virginia, Washington, and Wisconsin. You must be located in one of these states in order to use the Services.
You are responsible for your use of the Services and for any consequences thereof. You may use the Services only if you can form a binding contract with Framework and are not a person barred from accessing the Services under the laws of the United States or other applicable jurisdiction. The Services are not available to individuals under the age of eighteen (18). You may use the Services only in compliance with these Terms and all applicable local, state, national, and international laws, rules, and regulations.
The form and nature of the Services are always evolving and may change from time to time without prior notice to you. Framework may decide to temporarily or permanently stop providing the Services, or any features within the Services, to you or to users generally, and may not be able to provide you with prior notice when doing so. Framework retains the right to create limits on use of the Services and/or storage of your information at its sole discretion.
The Services may include advertisements. In consideration for Framework granting you access to and use of the Services, you agree that Framework, its partners, and any third-party providers may place such advertising on the Services.
Registering for an Account
You must create a user account in order to use the Services. You may create such an account by registering through the Website and providing accurate and complete information as requested, including completion of a health intake questionnaire (the “Registration”).
You must update your Registration as needed to keep it accurate and complete.
Upon completion of your Registration, you may consult with a Physician and, if medically indicated, place an order for products. Some products require a prescription, while others do not. A Physician licensed in your state will review your Registration and determine medical appropriateness. The issuance of any prescription is not guaranteed.
If a prescription is required and not issued, Framework will decline your order and refund your payment. Framework does not endorse any specific medications, pharmacies, or physicians.
Payment for the Services
Some products require purchase on a subscription basis for a monthly subscription fee (the “Subscription Fee”). The Subscription Fee may include Physician consultations, prescriptions filled by the Pharmacy, shipping, platform fees, and applicable taxes. By submitting payment information, you authorize Framework and its payment processors to charge amounts due. Federal and state health care programs do not cover the Services. You are solely responsible for all costs and agree that no reimbursement claims will be submitted on your behalf.
Privacy
Any information you provide to Framework is subject to Framework’s Privacy Policy. By using the Services, you consent to the collection and use of your information as described therein. Certain communications are considered part of the Services and may not be opted out of.
Passwords
You are solely responsible for safeguarding your account credentials. Framework is not liable for any loss or damage arising from your failure to protect your account.
Content Regarding the Services
Framework does not verify the accuracy of third-party content. Use of any information obtained through the Services is at your own risk. Framework is not liable for any content made available via the Services.
Framework’s Rights
Framework owns all rights, title, and interest in and to the Website and Services. No ownership rights are transferred to you. Feedback you provide may be used by Framework without obligation to you.
Restrictions on Use
Framework may suspend or terminate access to the Services at any time. You may not misuse the Services, interfere with systems, scrape content, or engage in prohibited conduct.
Ending These Terms
You may terminate your agreement by discontinuing use of the Services. Framework may terminate or suspend Services at any time. Certain provisions survive termination.
Medical records are retained as required by law.
Disclaimers, Limitation of Liability, and Indemnity
The Services are provided “AS IS” and “AS AVAILABLE.” Framework, its affiliates, Physicians, and Pharmacies disclaim all warranties to the maximum extent permitted by law.
To the extent legally permitted, you release Framework from liability related to medical services provided by Physicians or Pharmacies. Aggregate liability shall not exceed the greater of $100 or the amount paid in the previous six months.
You agree to indemnify and hold harmless Framework and its affiliates from third-party claims arising from your use of the Services.
Miscellaneous Terms
These Terms are governed by California law. Any disputes shall be brought in Los Angeles County, California. These Terms constitute the entire agreement between you and Framework.
Framework may revise these Terms at any time. Continued use of the Services constitutes acceptance of revised Terms.
Supplemental Terms Applicable to Physicians
Physicians using the Framework platform must be properly licensed and comply with all applicable laws. Framework does not practice medicine and is not responsible for Physician services. Physicians agree to indemnify Framework for claims arising from their medical services.
Code of Conduct
Patients must provide accurate information, treat staff respectfully, follow medical instructions, and comply with payment obligations. Framework reserves the right to refuse service for violations.
Return and Refund Policy
All sales are final once an order has been processed and/or shipped.
Due to the nature of prescription medications, compounded medications, and health-related products, Framework does not accept returns, exchanges, or refunds for any products that have been delivered, opened, used, partially used, or otherwise received by the customer. This policy applies without exception and is necessary to ensure patient safety, product integrity, and compliance with applicable pharmacy and health regulations.
Once a product has been shipped, ownership and risk of loss transfer to you, and Framework has no obligation to issue a refund or replacement, including but not limited to situations involving dissatisfaction with the product, perceived lack of effectiveness, or discontinuation of use for any reason.
Framework does not guarantee any specific medical, therapeutic, cosmetic, or weight-related results, outcomes, or benefits from the use of any product or service offered through the Services. Individual results may vary significantly based on medical history, adherence to treatment, lifestyle factors, and other variables outside of Framework’s control. Lack of results, slower-than-expected results, or outcomes that differ from expectations do not constitute grounds for a refund, credit, or chargeback.
Framework makes no representations or warranties regarding the effectiveness, safety, or suitability of any product for any particular individual beyond those required by applicable law. There is no obligation on Framework’s part to refund any fees or charges based on lack of results, perceived inefficacy, or subjective dissatisfaction.
Refunds may be issued solely at Framework’s discretion and only in limited circumstances, such as if an order is canceled before a prescription is issued to the pharmacy or before the product has shipped. Once a prescription has been transmitted to a pharmacy or a product has been shipped, no refunds will be provided.
By purchasing or using any product or service through Framework, you expressly acknowledge and agree to this Return and Refund Policy and waive any claim to refunds, credits, or returns except as expressly stated herein.
